THESE ARE THE OFFICIAL COMPETITION RULES FOR "The BIZZY Project". YOU HEREBY AGREE TO THESE RULES BY ENTERING THE COMPETITION AS PROVIDED HEREIN. 

YOU ALSO AGREE THAT YOUR ENTRY AND THE PERSONAL INFORMATION COLLECTED FROM YOU IN CONNECTION WITH THIS COMPETITION WILL BE SHARED WITH ANY SPONSOR/S. SPONSOR’S USE OF YOUR PERSONAL INFORMATION IS SUBJECT TO SPONSOR’S PRIVACY POLICIES AT THE LINKS PROVIDED BELOW. NEITHER SPONSOR NOR BIZZY SHALL BE RESPONSIBLE IN ANY WAY FOR ANY COSTS INCURRED BY YOU OR YOUR TEAM IN CONNECTION WITH THIS CONTEST.

1) Competition Description. 

BIZZY Coffee's "The BIZZY Project" Competition (the "Competition") is a business idea competition to give early stage and aspiring entrepreneurs access to tools, training and networks needed to build businesses. The Competition's proponent is Get BIZZY Inc. (“Proponent”).

Entrants to the Competition may be comprised of teams of one (1) to two (2) persons (“Entrant/s”). As set forth in further detail below, Entrants will submit their entries (which includes information related to their business idea), and there will be two rounds to the Competition, with each round narrowing the field of original Entrants, subject to these Official Rules (the “Rules”).

In accordance with these Rules, (A) at the end of Round One, judges will select up to five (5) semi-finalist Entrants to move forward to Round Two, (B) at the end of Round Two, judges will select one (1) grand prize winner.

2) Competition Period. The Competition begins on April 18, 2016 at 9:00:00 A.M. Central Standard Time (CST) and the deadline for Entrants to enter the Competition shall be May 27, 2016 at 11:59:59 P.M. Central Standard Time (CST) (the “Initial Entry Deadline”). The overall Competition ends on June 30, 2016 at 11:59:59 P.M. Central Standard Time (CST). The rounds of the Competition will occur as follows:

(a) Round One:

i) Entries due between: April 18, 2016 – May 27, 2016
ii) Up to 5 semi-finalist Entrants selected June 3, 2016


(b) Round Two:

i) June 3, 2016 – June 24, 2016
ii) Semi-finalist deadline of Video Submissions, June 24, 2016
iii) One (1) grand winner to be selected June 30, 2016

3) How To Enter. To enter, an Entrant must do each of the following during the Competition Period:

(a) Prior to the end of the Initial Entry Deadline:

i) submit a completed application through this form;

    (b) If after Round One, an Entrant is selected as one of up to five (5) semi-finalists, each semi-finalist must complete the following during Round Two and prior to the June 24, 2016:

    i) Submit a sixty (90) second (or less) elevator pitch through a video introducing the project the team wants to implement

    Each Entrant is only entitled to one (1) entry during the Competition Period. Any attempt by any Entrant to obtain more than the stated number of entries by using multiple/ different e-mail addresses, identities, registrations and logins, or any other methods will void that Entrant’s entries and that Entrant may be disqualified. Use of any automated system is prohibited and will result in disqualification.

    All entries to enter the Competition must be received by 11:59:59 P.M. Central Standard Time (EST) on the last day of the Initial Entry Deadline. Any submission not meeting the aforementioned criteria will be disqualified.

    Sponsor accepts no responsibility for submissions lost, delayed, damaged, defaced, or mislaid, howsoever caused. Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Competition, or any portion thereof, for any reason, without limitation.

    All materials, data, information and ideas, including without limitation any videos, PowerPoints and applications submitted by an Entrant hereunder during any of the Rounds of the Competition or otherwise shall be defined as “Entrant Content”.

    4) Binding Agreement.

    In order to enter the Competition, an Entrant must agree to these Rules and the terms and conditions herein. Because these Rules form a legally binding agreement with respect to this Competition, please read them carefully. If an Entrant does not agree to the Rules, such Entrant is not eligible to participate in the Competition or to win any of the prizes. An Entrant agrees that registration for this Competition and/or a submission of an entry in the Competition constitutes his or her agreement to these Rules.

    5) Eligibility.

    This Competition is open only to individuals who are permanent legal residents of the United States of America (defined for purposes of these Official Competition Rules as the 50 states (excluding Rhode Island) and the District of Columbia) who are 18 years of age or older at the time of entry. The following individuals are not eligible: employees, contractors, directors and officers of BIZZY and other Sponsors and their respective parents, affiliates, subsidiaries, distributors, web designers, judges, representatives, agents and advertising and promotion agencies and any other entity involved in the development or administration of this Competition, and their immediate family members (spouse, parent, child, sibling or “step” of each) or household members (those persons whether related or not who live in the same residence for at least three months during the twelve-month period preceding the start date of the Competition). Winners will be required to sign an Affidavit of Eligibility and complete relevant tax forms as a condition to the delivery of the applicable prize. Void where prohibited by law. All applicable federal, state and local laws apply.

    In addition to the foregoing, Entrants must meet the following eligibility criteria:

    (a) Individuals may form teams of up to two (2) people maximum;

    (b) One (1) entry per team may be submitted;

    (c) All entries must be completed and submitted on or before the given deadline at each round of the Competition;

    (d) An Entrant will not be eligible if, in Sponsor's sole and absolute discretion, the Entrant/s:

    i) is, or has been, convicted or under any investigation for fraud, misconduct (financial or otherwise) or other criminal activity;
    ii) promotes or suggests, directly or indirectly, the illegal use of firearms/weapons, money remittance, check cashing services, illegal gambling, use or sale of any illegal drugs (state or federal), prostitution or pornography, violence, or the underage use of alcohol or tobacco products;
    iii) suggests or encourages, directly or indirectly, the taking up of arms against any person, government or entity, or otherwise challenge or seek to overthrow any government;
    iv) disparages or denigrates (in writing or otherwise) any race, age, gender, disability, sexual orientation, ethnicity, religion, political orientation, national origin, citizenship, ancestry, marital status, veteran status or mental or physical disability or condition or otherwise discriminates (in an exclusionary way) against any of those groups based solely on being classified as fitting into those groups;
    v) disparages, denigrates, threatens (in writing or otherwise), or acts by means of adversarial or confrontational tactics to impact a product, service, person, industry, or organization including, but not limited to, Sponsor, Chase or any other Entrant;
    vi) conducts himself or herself, in an unsportsmanlike or inappropriate manner, including without limitation any attempt, directly or indirectly, to entice Sponsor to vote by offering any type of consideration, gift, award, or inducement, including merchandise, cash, online currency, discounts, lottery, vote trading or anything deemed to have value in exchange for votes, including donations to charity;
    vii) sends or delivers to Sponsor/s any samples or documents not permitted by these Rules;
    viii) uses, promotes or posts Prohibited Content (as defined below) on the Entrant Content or anywhere else; or
    ix) violates these Rules.

    6) Conduct.

    By entering the Competition, each Entrant agrees to comply with and be bound by the Rules. Failure to comply with these Rules may result in an Entrant’s disqualification from the Competition.

    Each Entrant further agrees to comply with and be bound by the decisions of the judges, which are final and binding in all respects.

    Sponsor reserves the right in its sole discretion to disqualify any Entrant it finds to be:

    (1) tampering or attempting to tamper with the entry process or the operation of the Competition;
    (2) violating the Rules;
    (3) violating the terms of service, conditions of use or general rules or guidelines of any of Sponsor’s properties or services;
    (4) acting in an unsportsmanlike or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person; or
    (5) failure to provide documentation verifying U.S. citizenship or permanent U.S. residency.

     

    Any false information provided within the context of the Competition by any Entrant concerning identity, postal address, ownership of rights or non-compliance with the Rules may result in the immediate disqualification of an Entrant from the Competition. Sponsor further reserves the right to disqualify any entry that they believe in their sole and unfettered discretion, infringes upon any third party right, violates any law or otherwise does not comply with these Rules.

    CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY PROPERTY OR UNDERMINE THE LEGITIMATE OPERATION OF THE COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

    7) Removal from the Competition.

    If an Entrant is deemed to be ineligible for any reason, it is grounds for Removal from the Competition without notice. "Removal from the Competition" means removing the Entrant from consideration for any prize. Sponsor retains the right at its sole discretion to determine eligibility and reserves the right to disqualify any Entrant for any reason. All decisions by Sponsor are final, binding and conclusive.

    8) Prohibited Content.

    All Entrant Content must be appropriate for all ages. Entrants represent and warrant that they will not submit any Entrant Content that contains (a) content not in English; (b) confidential information that violates any obligation of confidentiality; (c) any viruses, spyware, malware, or other malicious components that are designed to harm the functionality of a computer in any way; (d) content referencing, facilitating, containing or using, Prohibited Content (as defined below); or (e) content that infringes on the intellectual property rights of a third party. Prohibited Content may be removed immediately and without notice.

    "Prohibited Content" includes, but is not limited to, content that, the Sponsor/s in its sole and absolute discretion, determines violates the Rules or any applicable law, as well as content that promotes, suggests or encourages:

    (a) illegal gambling, including without limitation, any content related to casinos, sports books, bingo or poker to the extent they are on-line;

    (b) the illegal use of firearms/weapons/ammunition, any illegal drugs, prostitution, pornography, nudity, profanity or other adult content, violence, or the underage use of alcohol or tobacco products;

    (c) the taking up of arms against any person, government or entity or otherwise challenge or seek to overthrow any government;

    (d) Or otherwise contains or reflects:

    i) obscene, indecent, defamatory, libelous, slanderous and/or unlawful content;
    ii) content that infringes upon, or otherwise violates, the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary rights;
    iii) information or content that is false, misleading, deceptive or fraudulent;
    iv) hate speech, or other discriminatory, disparaging or denigrating content, whether directed at an individual or a group, and whether based upon race, age, gender, disability, sexual orientation, ethnicity, religion, political orientation, national origin, citizenship, ancestry, marital status, veteran status or mental or physical disability or condition;
    v) content that disparages, denigrates, threatens, or uses adversarial or confrontational tactics to impact a product, service, person, industry, or organization including, but not limited to, theSkimm, Chase or participants in the Competition;
    vi) content that is primarily intended to advance a religious denomination, expand membership or encourage conversion;
    vii) content advancing a particular political party or candidate or supporting lobbying for any particular party or candidate, or expanding or encouraging a membership or a particular political party, candidate or lobbying effort;
    viii) content inconsistent with the Rules; or
    ix) unsportsmanlike conduct.

     

    9) Judging and Selection of Winners. At each level of the Competition, entries will be judged by judges selected and appointed by Sponsor based on the following judging criteria:

    i) Project vision;
    ii) Project plan;
    iii) Strength of team members (written and oral communication and presentation skills); and
    iv) whether the submission adheres to these Rules.

     

    Sponsor reserves the right to select and appoint alternate judges at any time, at its sole discretion. Decisions of the judges are final and binding. If a winner is not able for whatever reason to accept his or her prize, then Sponsor reserves the right, but shall not be obligated to, to award the prize to another Entrant.

    10) Prizes.

    The five (5) semi-finalist Entrants will receive three (3) months of BIZZY Coffee subscription.

    The one (1) grand prize winner Entrant will receive:

    i) $5,000

    ii) Monthly mentorship calls with different members of the BIZZY team for six (6) months, utilizing the team’s experience across marketing, growth, product & technology, community building and financing

    Total Retail Value of the prizes is $ $5,924.81

    Decisions of the Sponsor are final and binding with respect to all matters related to the Competition. In no event shall Sponsor be obligated to award more prizes than the number of prizes stated in these Rules. No prize substitution, cash substitution, or assignment or transfer of prizes is permitted, except by Sponsor because of unavailability, in which case a prize of equal or greater value will be awarded. The winners will be notified by Sponsor. At the sole discretion of the Sponsor, disqualification, forfeiture and the selection of an alternate winner may result from any of the following: (1) a potential Grand Prize Winner's failure to respond to email notification within three (3) days after its transmission; (2) the return of an email notification as undeliverable after three (3) attempts; (3) a potential Grand Prize Winner's failure to provide Sponsor with satisfactory proof of age, identity and residency; (4) a potential Grand Prize Winner's failure to execute and return an Affidavit of Eligibility/ Liability/ Publicity Release within seven (7) days after its transmission; (5) a potential Grand Prize Winner's failure to validly claim the prize by [date]; and (6) any other non-compliance with the Official Rules.

    In the event of a prize forfeiture, the Sponsor may, in its sole discretion, award or not award the forfeited prize to an alternate winner. Winners shall be responsible and liable for all federal, state and local taxes on the value of the prize (see section 12 for more information). Entrants are encouraged to print out a copy of these Official Competition Rules for future reference.

    11) Privacy Notice.

    By participating in this Competition, Entrants agree that Sponsor can collect his or her personal information, and that if Sponsor cannot collect the required data, Entrants may not be eligible to participate in the Competition. Any personal information collected during the course of the Competition by Sponsor will only be used for administering this Competition and for other purposes as outlined in these Rules, and will be subject to the practices described in the Sponsor’s privacy policy. Entrants will have the right to access, review, rectify or cancel any personal data held by Sponsor through a request in writing.

    12) General Conditions. Any disputes that may arise hereunder shall be governed in all respects by the laws of the State of Minnesota without regard to the conflicts of laws principles of any jurisdiction. Any controversy or claim arising out of or relating to these Rules, their enforcement, arbitrability or interpretation, or the Competition, shall be submitted to final and binding arbitration, to be held in Minneapolis, Minnesota, before a single arbitrator in accordance with the commercial arbitration rules of the American Arbitration Association.

    Venue with respect to any such disputes not subject to arbitration and for entering judgment of any arbitration award shall be had in the state and federal courts of the State ofMinnesota. Prize winners are solely responsible for all federal, state and local taxes on prizes; Sponsor will issue to winner an I.R.S. Form 1099 for the retail prize value for tax reporting purposes.

    By participating in this Competition, Entrants agree to be bound by the terms of these Rules and by Sponsor’s decisions, which are final and binding on all matters pertaining to this Competition. Return of any prize or award notification may result in disqualification and selection of an alternate winner. Any potential winner who cannot be contacted within five (5) business days of attempted first notification will forfeit his or her prize. Potential prize winners may be required to sign, notarize, and return an Affidavit of Eligibility/Liability/Publicity Release, an I.R.S. Form W-9, within seven (7) days and provide any additional information that may be required by Sponsor. Failure to comply within this time period may result in disqualification and selection of an alternate winner. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Competition or in the announcement of the prizes or awards.

    Entrants certify that their submission is original, the submission is drawn without any help from any third party, and that they are the sole and exclusive owner and rights holder of the submitted submission (or if they are not sole and exclusive owner and rights holder of the submission, that they have obtained the necessary permission to include the submission in the Competition) and that they have the right to submit the submission in the Competition.

    Each Entrant agrees not to participate in the Competition in any manner that might: (i) infringe any third-party proprietary, intellectual property, industrial property, personal rights or other rights, including without limitation, copyright, trademark, patent, trade secret or confidentiality obligation; or (ii) otherwise violate applicable law in any countries in the world.

    Sponsor does not make any, and hereby disclaim any and all, representations or warranties of any kind, express or implied, regarding any prize, which is awarded “as is.”. Participation in the Competition is at Entrant’s own risk. Further, if, for any reason, the Competition is not capable of running as planned for reasons outside the control of the Sponsor which, in the sole opinion of Sponsor, may corrupt or affect the administration, security, fairness, integrity or proper conduct of the Competition (or portion thereof), Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Competition (or portion thereof).

    13) No Recourse to Judicial or Other Procedures.

    To the extent permitted by law, the rights to litigate, to seek injunctive relief, or to any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Competition are hereby excluded, and each Entrant expressly waive any and all such rights.

    14) LIMITATIONS OF LIABILITY:

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, EACH ENTRANT INDEMNIFIES AND AGREES TO KEEP INDEMNIFIED SPONSOR/S AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, SUCCESSORS AND ASSIGNS AT ALL TIMES FROM AND AGAINST ANY LIABILITY, CLAIMS, DEMANDS, LOSSES, DAMAGES, COSTS AND EXPENSES RESULTING FROM, RELATED TO OR INCIDENTAL TO ANY ACT, DEFAULT OR OMISSION BY SUCH ENTRANT AND/OR A BREACH OF ANY OF THESE RULES, INCLUDING WITHOUT LIMITATION REPRESENTATION AND WARRANTY BY SUCH ENTRANT SET FORTH HEREIN OR ANY BREACH, NON-OBSERVANCE, ACT OR OMISSION WHETHER NEGLIGENT OR OTHERWISE, PURSUANT TO THESE RULES BY SUCH ENTRANT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, EACH ENTRANT AGREES TO HOLD SPONSOR/S AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, SUCCCESSORS AND ASSIGNS HARMLESS FOR ANY INJURY OR DAMAGE CAUSED OR CLAIMED TO BE CAUSED BY PARTICIPATION IN THE COMPETITION AND/OR USE OR ACCEPTANCE OF ANY PRIZE WON OR AWARDED. THE WINNERS ASSUME ALL LIABILITY (AND NEITHER SPONSOR NOR CHASE SHALL BE LIABLE) FOR ANY INJURY, DEATH, OR DAMAGE CAUSED, OR ALLEGEDLY CAUSED, BY PARTICIPATING IN THIS COMPETITION OR USE OR REDEMPTION OF ANY PRIZE, INCLUDING WITHOUT LIMITATION ANY TRAVEL OR ACTIVITY RELATED THERETO

    15) Third Parties.

    Sponsor is not responsible for the policies, actions, or inactions of others, including Entrant’s parents/legal guardian that might prevent the Entrant from entering, participating, claiming a prize and/or being awarded in this Competition.

    16) Intellectual Property.

    By registering for the Competition and/or submitting an entry, the Entrant agrees explicitly that all components of its Entrant Content are original creations. Any intellectual property infringement, misuse or plagiarism of another’s work in any form or state will result in immediate disqualification and forfeiture of eligibility to receive all awards, recognition and prizes. Each Entrant also agrees to allow Sponsor to make public statements regarding any disqualifications and any grounds for disqualification. All intellectual property and intellectual property rights in any entries that belonged to the Entrants will remain with the Entrants; provided, however, by registering for the Competition and/or submitting an entry, an Entrant grants to Sponsor a worldwide, non-exclusive right and license to use, print, copy, modify, distribute, promote and publicly display such Entrant’s Entrant Content and any other submission materials for any purpose in connection with the Competition, including without limitation (a) press and media communications; and (b) display on Sponsor’s Web sites, without any compensation to such Entrant. Entrants also agree to participate in any media or promotional activity regarding the Competition. If an Entrant is a winner of this Competition, such Entrant agrees that Sponsor may use Entrant’s (and each individual member’s) likeness to administer and promote the Competition and to conduct media interviews and promotional events. Entrants further agree that Sponsor shall not have any liability whatsoever for any unauthorized copying or reproduction of any Entrant Content or material submitted thereon by Entrants in connection with the Competition.

    17) Internet.

    Sponsor is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission. Sponsor is not responsible for theft or destruction or unauthorized access to or alterations of Competition materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind. Sponsor is not responsible for inaccurate transmissions of or failure to display Competition materials on account of technical problems or traffic congestion on the Internet or at any Web site or any combination thereof. If for any reason the Internet portion of the Competition is not capable of running as planned, including as a result of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Competition, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Competition or any portion thereof, without limitation.

    18) Severability.

    If any provision(s) of these Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.

    19) Official Rules/Winners’ List Requests.

    To obtain a copy of these Rules or for notification of the winners, send a self-addressed stamped envelope to: Get BIZZY Inc, 322 Wyndham Cir E, New Brighton, Minneapolis, MN 55112. Requests for winners' lists must be received no later than three months after the end of the Competition Period.

    20) Sponsor.

    The Competition is sponsored by Get BIZZY Inc, (owner and operator of www.bizzycoffee.com), having an address of Get BIZZY Inc, 322 Wyndham Cir E, New Brighton, Minneapolis, MN 55112 ("Sponsor").
